Strict liability is not the whole case
Civil Code section 3342 is the starting rule, not the file. Homeowners or renters insurance, landlord knowledge of a dangerous dog, and animal-control history often decide whether there is real coverage. A “he provoked the dog” defense is common and fact-heavy.
Injuries
Facial scars, nerve damage, infection, and the psychological piece (especially for children) are what make these claims larger than the ER bill. Do not accept a quick medical-pay check as the end of the claim if scars or surgery are still coming.
Questions
What if the owner is a neighbor or friend? The claim is usually against insurance, not their checking account. That is still a real case.
What if there was no bite, only a knock-down? Strict-liability bite statutes may not apply, but negligence still can (unleashed dog, broken fence, prior attacks).
